Two decades of research on euthanasia in the Netherlands have resulted into clear insights in the frequency and characteristics of euthanasia and other medical end-of-life decisions in the Netherlands. These empirical studies have contributed to the quality of the public debate, and to the regulating and public control of euthanasia and physician-assisted suicide. No slippery slope seems to have occurred. Physicians seem to adhere to the criteria for due care in the large majority of cases. Further, it has been shown (...) that the majority of physicians think that the euthanasia Act has improved their legal certainty and contributes to the carefulness of life-terminating acts. In 2005, eighty percent of the euthanasia cases were reported to the review committees. Thus, the transparency envisaged by the Act still does not extend to all cases. Unreported cases almost all involve the use of opioids, and are not considered to be euthanasia by physicians. More education and debate is needed to disentangle in these situations which acts should be regarded as euthanasia and which should not. Medical end-of-life decision-making is a crucial part of end-of-life care. It should therefore be given continuous attention in health care policy and medical training. Systematic periodic research is crucial for enhancing our understanding of end-of-life care in modern medicine, in which the pursuit of a good quality of dying is nowadays widely recognized as an important goal, in addition to the traditional goals such as curing diseases and prolonging life. Qualitative coalitional games (QCGs) were introduced as abstract formal models of goal-oriented cooperative systems. A QCG is a game in which each agent is assumed to have some goal to achieve, and in which agents must typically cooperate with others in order to satisfy their goals. In this paper, we show how it is possible to reason about QCGs using Coalition Logic (CL), a formalism intended to facilitate reasoning about coalitional powers in game-like multiagent systems. We introduce a correspondence relation (...) between QCGs and interpretations for CL, which defines the circumstances under which a CL interpretation correctly characterises a QCG. The complexity of deciding correspondence between QCGs and interpretations for CL is shown to vary from being tractable up to Πp 2-complete, depending on the representation chosen for the QCG and interpretation. We then show how various properties and solution concepts of QCGs can be characterised as CL formula schemes. The ideas are illustrated via a detailed worked example, in which we demonstrate how a model checker can be deployed to investigate whether a particular system has the properties in question. Paul Cilliers has developed a novel post-structural approach to complexity that has influenced several writers contributing to the current complexity literature. Concomitantly however, Cilliers advocates for modelling complex systems using connectionist neural networks (rather than analytic, rule-based models). In this paper, I argue that it is dilemmic to simultaneously hold these two positions. Cilliers’ post-structural interpretation of complexity states that models of complex systems are always contextual and provisional; there is no exclusive model of complex systems. This sentiment however (...) appears at odds with Cilliers’ promotion of connectionist neural networks as the best way to model complex systems. The lesson is that those who currently follow Cilliers’ post-structural approach to complexity cannot also develop a preferred model of complex systems, and those who currently advocate for some preferred model of complex systems cannot adopt the post-structural approach to complexity without giving up the purported objectivity and/or superiority of their preferred model. Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

This paper provides an empirical case study of the relationship between corporate social responsibility (CSR) and the new competition regulation in the Netherlands. The leading question in this case study is whether the new institutional arrangement has allowed for the possibility that reasonable exceptions can be made to the principle that inter-firm cooperation is prohibited. That is to say: does the new institutional arrangement allow for the possibility of 'well organized but not 'perfect' markets'? The investigation focuses on the Netherlands, (...) which constitutes an exemplary case as the Dutch are committed to both strengthen the competitiveness of the market and allow for exceptions on behalf of non-economic values such as CSR. The authors expect that the Dutch context will prevent a doctrinal and categorical rejecting of any good argument to make an exception to the rule that inter-firm cooperation must be prohibited. BackgroundIn about one in 10,000 cases, a published article is retracted. This very often means that the results it reports are flawed. Several authors have voiced concerns about the presence of retracted research in the memory of science. In particular, a retracted result is propagated by citing it. In the published literature, many instances are given of retracted articles that are cited both before and after their retraction. Even worse is the possibility that these articles in turn are cited in (...) such a way that the retracted result is propagated further.MethodsWe have conducted a case study to find out how a retracted article is cited and whether retracted results are propagated through indirect citations. We have constructed the entire citation network for this case.ResultsWe show that directly citing articles is an important source of propagation of retracted research results. In contrast, in our case study, indirect citations do not contribute to the propagation of the retracted result.ConclusionsWhile admitting the limitations of a study involving a single case, we think there are reasons for the non-contribution of indirect citations that hold beyond our case study. BackgroundAn important principle underlying the Dutch Euthanasia Act is physicians' responsibility to alleviate patients' suffering. The Dutch Act states that euthanasia and physician-assisted suicide are not punishable if the attending physician acts in accordance with criteria of due care. These criteria concern the patient's request, the patient's suffering (unbearable and hopeless), the information provided to the patient, the presence of reasonable alternatives, consultation of another physician and the applied method of ending life. To demonstrate their compliance, the Act requires physicians (...) to report euthanasia to a review committee. We studied which arguments Dutch physicians use to substantiate their adherence to the criteria and which aspects attract review committees' attention.MethodsWe examined 158 files of reported euthanasia and physician-assisted suicide cases that were approved by the review committees. We studied the physicians' reports and the verdicts of the review committees by using a checklist.ResultsPhysicians reported that the patient's request had been well-considered because the patient was clear-headed (65%) and/or had repeated the request several times (23%). Unbearable suffering was often substantiated with physical symptoms (62%), function loss (33%), dependency (28%) or deterioration (15%). In 35%, physicians reported that there had been alternatives to relieve patients' suffering which were refused by the majority. The nature of the relationship with the consultant was sometimes unclear: the consultant was reported to have been an unknown colleague (39%), a known colleague (21%), otherwise (25%), or not clearly specified in the report (24%). Review committees relatively often scrutinized the consultation (41%) and the patient's (unbearable) suffering (32%); they had few questions about possible alternatives (1%).ConclusionDutch physicians substantiate their adherence to the criteria in a variable way with an emphasis on physical symptoms. The information they provide is in most cases sufficient to enable adequate review. Review committees' control seems to focus on (unbearable) suffering and on procedural issues. (shrink)

A quasi-order Q induces two natural quasi-orders on $${\mathcal{P}(Q)}$$, but if Q is a well-quasi-order, then these quasi-orders need not necessarily be well-quasi-orders. Nevertheless, Goubault-Larrecq (Proceedings of the 22nd Annual IEEE Symposium 4 on Logic in Computer Science (LICS’07), pp. 453–462, 2007) showed that moving from a well-quasi-order Q to the quasi-orders on $${\mathcal{P}(Q)}$$ preserves well-quasi-orderedness in a topological sense. Specifically, Goubault-Larrecq proved that the upper topologies of the induced quasi-orders on $${\mathcal{P}(Q)}$$ are Noetherian, which means that they contain no (...) infinite strictly descending sequences of closed sets. We analyze various theorems of the form “if Q is a well-quasi-order then a certain topology on (a subset of) $${\mathcal{P}(Q)}$$ is Noetherian” in the style of reverse mathematics, proving that these theorems are equivalent to ACA 0 over RCA 0. To state these theorems in RCA 0 we introduce a new framework for dealing with second-countable topological spaces. (shrink)

Against the background of the current European competitive media landscape, the media are more and more compelled to legitimize their activities in their own national context as well as at a European level. Meanwhile, the nature of the media diversity in The Netherlands has changed tremendously; from a society divided along political and religious lines, it has evolved towards a multi-ethnic society. Hence, both the conceptualizing and operationalizing of media diversity from an academic as well as a media practical perspective (...) prove to be hot topics. An expert meeting was held at the Department of Communication at Radboud University Nijmegen in December 2004 in which the contours of media diversity in general and in The Netherlands in particular were explored. Institutional performance as well as program-related aspects linked to the notion of media diversity were discussed. Media diversity was explored from the angle of media economics as well as from the perspective of the program/format level. In addition, the audience reception perspective as well as methodologically problematic aspects one encounters when measuring media diversity were assessed. What follows here is a selection of several most pertinent views on this complex topic. We welcome each critical insight from other geographical contexts which might stimulate the debate on measures of open and reflective diversity in the media. (shrink)

During the COVID-19 crisis there have been many difficult decisions governments and other decision makers had to make. E.g. do we go for a total lock down or keep schools open? How many people and which people should be tested? Although there are many good models from e.g. epidemiologists on the spread of the virus under certain conditions, these models do not directly translate into the interventions that can be taken by government. Neither can these models contribute to understand the (...) economic and/or social consequences of the interventions. However, effective and sustainable solutions need to take into account this combination of factors. In this paper, we propose an agent-based social simulation tool, ASSOCC, that supports decision makers understand possible consequences of policy interventions, but exploring the combined social, health and economic consequences of these interventions. The Remmelink Committee published its report on medical decisions at the end of life in the Netherlands in September 1991. As a result, the Dutch debate about physician aid‐in‐dying has been broadened to include life‐terminating acts that have not been explicitly requested by the patient.

ABSTRACTThe remarkable philosophical present-day turn to Paul pays a lot of attention to the particular role played by the famous distinctions that structure Paul’s rhetoric such as the distinction between faith and law, life and death, and spirit and flesh. These distinctions lead to the question of whether Paul endorses a dualism or not. In this essay, the author investigates Badiou’s and Agamben’s readings of Paul and asks whether one cannot find a form of dialectics rather (...) than dualism in these readings. The concept of the exception seems to corroborate this suggestion. To examine whether this suggestion makes sense, the author first discusses Badiou’s focus on the antidialectics of death and resurrection as well as the dialectical remnants in Badiou’s reading of Paul. Subsequently, the author analyses Agamben’s dialectical account of the Pauline terms katargein, chrēsis and charis. (shrink)

Research skills are important for university graduates, but little is known about undergraduates’ motivation for research. In this study, self-efficacy beliefs and intrinsic motivation for several research activities were measured three times during an undergraduate research project. In order to promote self-efficacy for writing and collaboration, a collaboration script was developed and tested on half of the students. Twelve students were interviewed three times to gather in-depth information about motivational and self-efficacy beliefs. All measures except intrinsic motivation for research increased (...) significantly during the project. Interview results suggest that enactive mastery and positive social interdependence promoted self-efficacy. Feelings of relatedness seemed to promote intrinsic motivation for writing. Lack of autonomy and low perceived relevance may explain why motivation for research remained stable. The script had no impact on self-efficacy beliefs. Relatedness,... (shrink)

In both “Answering for Sense” and “Sharing Voices,” Jean-Luc Nancy offers an account of the poet as an interpreter of the gods. The voice of the poet in both Homer’s Iliad and Plato’s Ion is intrinsically and originally doubled. Although there is no divine voice outside of the poet’s voice, the divine voice speaks in the poet’s voice and the poetic voice gives a voice to that of the goddess or the muse. What exactly is at stake in this phenomenon (...) that we encounter here in the poet, namely that of gods making us speak? How is it related to the threshold of speech and communication that Nancy invokes in Adoration, when he also mentions the gods that make us speak? In this essay, I want to think with Nancy to see what is at stake in the figure of a voice on the threshold of speech and communication. I consider how the figure of the gods that make us speak is brought into play to elucidate the threshold of language and how this figure, as that which makes us speak, somehow offers the crossing of this threshold. To this end, I want to discuss three different figures or scenes in which the gods make us speak. In the first part of this article, I explore in more detail Nancy’s own account of the poet as interpreter of the divine voice. What does it mean for the poet to give a voice to the goddess and to desire this giving a voice? What is the demand or call to which the poet in giving a voice answers? To further the analysis of this divine interpreter, I want to compare this interpreter with two other ones which arise in two other basic scenes in which the gods make an interpreter speak. The first concerns the scene of the calling of the prophet Jeremiah in the book of the same name. The second concerns Saint Paul’s reflections on the glossolalist in the First Letter to the Corinthians. By exploring the differences between these three divine interpreters, I aim to further elucidate and assess the phenomenon of the interpreter and the double voice that characterizes Nancy’s poet. In order to develop a hermeneutic-phenomenological analysis of testimony, this essay will first argue that testimony is “said in many ways” without being homonymous and that contemporary epistemological approaches to testimony are not capable of accounting for all paradigmatic forms of testimony. Second, it is argued, following and extending the work of Paul Ricoeur, that by emphasizing the sense of engagement or Bezogenheit as a basic characteristic of testimony, we may find another approach to testimony that offers a phenomenological (...) alternative to the observational model of witnessing and the accompanying conception of testimony as report. Third, this approach is further developed and analyzed in terms of the four elements of testimony, namely, subject matter, witness, act of testifying, and addressee. (shrink)

Resolving conflicts between different measurements ofa property of a physical system may be a key step in a discoveryprocess. With the emergence of large-scale databases and knowledgebases with property measurements, computer support for the task ofconflict resolution has become highly desirable. We will describe amethod for model-based conflict resolution and the accompanyingcomputer tool KIMA, which have been applied in a case-study inmaterials science. In order to be a useful aid to scientists, the toolneeds to be integrated with other tools in (...) a computer-supporteddiscovery environment. One of the key concepts of Paul Ricoeur’s hermeneutics is the notion of distanciation. In this article we show that Ricoeur introduces this notion as a correction of Heidegger’s focus on being-in and Gadamer’s emphasis on belonging . Ricoeur argues that distanciation does not lead to the uprooting of our belonging to a tradition. Rather, distanciation is an integral part of the dynamics that constitutes tradition. We discuss the different senses in which Ricoeur understands distanciation as a positive and (...) productive aspect of tradition. In particular, we discuss the ontological aspect of distanciation. In his discussion of both the long way of hermeneutics and the creative dimension of distanciation in fiction, Ricoeur argues that it is distanciation that opens up the possibility of understanding our own being-in-the-world. This involvement of distanciation in the disclosure and understanding of being allows us to show that distanciation determines what “kind” of being is understood: what is interpreted in hermeneutics and disclosed in poetics is never being as such, but “being-interpreted” and “being-as,” respectively. This leads us to a description of the difference between Ricoeur’s and Heidegger’s thought concerning the ontological dimension of their hermeneutics. (shrink)

Since the emergence of the innovative field of artificial intelligence in the 1960s, the late Hubert Dreyfus insisted on the ontological distinction between man and machine, human and artificial intelligence. In the different editions of his classic and influential book What computers can’t do, he posits that an algorithmic machine can never fully simulate the complex functioning of the human mind—not now, nor in the future. Dreyfus’ categorical distinctions between man and machine are still relevant today, but their relation has (...) become more complex in our increasingly data-driven society. We, humans, are continuously immersed within a technological universe, while at the same time ubiquitous computing, in the words of computer scientist Mark Weiser, “forces computers to live out here in the world with people” The cell phone reader. Peter Lang Publishing, New York, 2006, p 20). Dreyfus’ ideas are therefore challenged by thinkers such as Weiser, Kevin Kelly, Bruno Latour, Philip Agre, and Peter Paul Verbeek, who all argue that humans are much more intrinsically linked to machines than the original dichotomy suggests—they have evolved in concert. Through a discussion of the classical concepts of individuum and ‘authenticity’ within Western civilization, this paper argues that within the ever-expanding data-sphere of the twenty-first century, a new concept of man as ‘aggregate of data’ has emerged, which further erodes and undermines the categorical distinction between man and machine. This raises political and ethical questions beyond the confines of technology and artificial intelligence. Moreover, this seemingly never-ending debate on what computers should do provokes the philosophical necessity to once again define the concept of what it is to be ‘human.’. (shrink)

ABSTRACTThe remarkable philosophical present-day turn to Paul pays a lot of attention to the particular role played by the famous distinctions that structure Paul’s rhetoric such as the distinction between faith and law, life and death, and spirit and flesh. These distinctions lead to the question of whether Paul endorses a dualism or not. In this essay, the author investigates Badiou’s and Agamben’s readings of Paul and asks whether one cannot find a form of dialectics rather (...) than dualism in these readings. The concept of the exception seems to corroborate this suggestion. To examine whether this suggestion makes sense, the author first discusses Badiou’s focus on the antidialectics of death and resurrection as well as the dialectical remnants in Badiou’s reading of Paul. Subsequently, the author analyses Agamben’s dialectical account of the Pauline terms katargein, chrēsis and charis. (shrink)

Central to this volume are two philosophical powerhouses of the early modern period: Gottfried Wilhelm Leibniz and Pierre Bayle. Born in, respectively, 1646 and 1647, both made for an astonishing career in a variety of scholarly disciplines and reached, if not equal, then certainly comparable fame in the course of their lives. Nowadays, Bayle's reputation is eclipsed by that of Leibniz, who is the focus of yearly conferences and libraries of scholarship, while Bayle had to await the later twentieth century (...) to be rediscovered. In this article, I will explore the archeology of the concept of attestation in Ricoeur’s work. In a brief discussion of his early reflections on Husserl’s concept of the ego (as an example of reflexive philosophy), I show how the dialectic of trust and suspicion enters Ricoeur’s hermeneutic concerns. I argue that this dialectics remains present in his account of attestation. By a brief confrontation with Heidegger’s notion of attestation as developed in Being and Time, I show that the uniqueness (...) of Ricoeur’s account of attestation is to be found in this dialectic of trust and suspicion that he reinterprets in his later work in light of the concept of attestation. It is well-known that the early Heidegger offers important reflec­tions on the Christian experience of life in his accounts of Saint Paul and Saint Augustine. Yet, what is the systematic meaning of Heidegger’s phenomenology of religion? This essay aims to discuss this question by connecting themes from Die Phänomenologie des religiösen Lebens to Heidegger’s attempt to provide his own version of phenomenology in Einführung in die phänomenologische Forschung. Heidegger’s position with respect to Husserl’s phenomenology becomes clearer, I argue, when (...) his problematization of the onto-theological structures he discerns at the heart of the philosophers he discusses, such as Descartes and Augustine, is taken into account and when it is shown how the phenomenology of religion exceeds the boundaries of a phenomenology that studies consciousness alone. In fact, the explication of the (purified) Christian experience of life and the concep­tion of God at stake in this experience allows Heidegger to articulate a form of phenomenology purified from onto-theological tendencies. The much-acclaimed present-day philosophical turn to the letters of Saint Paul points to a profound consonance between ancient and modern thought. Such is the bold claim of this study in which scholars from contemporary continental philosophy, new testamentary studies and ancient philosophy discuss with each other the meaning Paul's terms pistis, faith. In this volume, this theme discusses in detail the threefold relation between Paul and continental thought, the Graeco-Roman world, and political theology. It is shown that (...) pistis does not only concern a mode of knowing, but rather concerns the human ethos or mode of existence as a whole. Moreover, it is shown that the present-day political theological interest in Paul can be seen as an attempt to recuperate Paul’s pistis in this comprehensive sense. Finally, an important discussion concerning the specific ontological implications and background of this reinterpretation of pistis is examined by comparing the ancient ontological commitments to those of the present-day philosophers. Thus, the volume offers an insight in a crucial consonance of ancient and modern thought concerning the question of pistis in Paul while not forgetting to stipulate important differences. (shrink)

This detailed study examines the close cooperation between the two main figures of the Marburg School, Hermann Cohen and Paul Natorp, primarily from the time that Natorp came to the University of Marburg in 1880 to write his Habilitationsschrift under Cohen until Cohen’s resignation from Marburg in 1912. It is a common view that during this period Cohen and Natorp were of one philosophical mind: Cohen developed the basic premises of Marburg Kantianism, first in his explications of Kant’s three (...) Critiques, and later in his own philosophical system [Logic of Pure Cognition, Ethics of the Pure Will, and Aesthetics of Pure Feeling ], while Natorp used these premises in his historical studies and in the construction of his social pedagogy. On this account, it was not until Cohen’s departure from Marburg, or even not until the latter’s death, that Natorp’s philosophy began to differentiate clearly from Cohen’s, taking an increasingly metaphysical-mystical turn. Holzhey successfully undermines this view. He shows that during Cohen’s Marburg period Natorp was actually critical of some basic aspects of Cohen’s epistemic logic, ethics, and philosophy of religion, but that Natorp underplayed his disagreements and largely kept them from becoming public. As humans, we frequently engage in mental time travel, reliving past experiences and imagining possible future events. This study examined whether similar factors affect the subjective experience associated with remembering the past and imagining the future. Participants mentally “re-experienced” or “pre-experienced” positive and negative events that differed in their temporal distance from the present , and then rated the phenomenal characteristics associated with their representations. For both past and future, representations of positive events were associated with a greater feeling of (...) re-experiencing than representations of negative events. In addition, representations of temporally close events contained more sensorial and contextual details, and generated a stronger feeling of re-experiencing than representations of temporally distant events. It is suggested that the way we both remember our past and imagine our future is constrained by our current goals. (shrink)

The growth of global value chains (GVCs) and the emergence of novel forms of value chain governance pose two questions for normative business ethics. First, how should we conceptualize the relationships between members of a GVC? Second, what ethical implications follow from these relationships, both with respect to interactions between GVC members and with respect to achieving broader transnational governance goals? We address these questions by examining the emergence of transnational eco-labeling as an increasingly prominent form of GVC governance that (...) is redefining the relationship between nominally independent firms. On the first question, we argue that GVCs occupy a middle ground between intrafirm and interfirm transactions, thereby posing a challenge to theoretical frameworks that attempt to apply ethical standards based on transaction types. On the second question, we argue that this unique institutional status leads to a range of novel ethical considerations and dilemmas for GVC members. Lead firms, their suppliers, and third-party standard-setters all confront new ethical quandaries when third-party eco-labeling is introduced to a GVC. The nature of these quandaries means that, while GVCs may be well-positioned to serve as instruments of transnational governance, they are frequently not well-oriented to do so. Our analysis marks an initial attempt to map the ethical considerations that apply to members of a GVC, and in doing so, places the literature on normative business ethics and transnational governance in a closer conversation. This article intends to give an overview of corporate governance in South Africa. It starts by making a distinction between (...) broad and narrow conceptions of corporate governance. Before applying this distinction to the practice of corporate governance in South Africa, a brief overview of the corporate landscape in South Africa is provided. Then the South African situation with regard to broad and narrow corporate governance respectively is analysed. The article ends with a discussion of the review of corporate governance that currently is in the making in South Africa. Throughout the article both the financial and ethical dimensions of corporate governance is attended to. (shrink)
